Terms of Service

These Terms of Service govern access to and use of learn.ultimategolfeducation.com, Ultimate Golf Education online learning, in-person workshops, memberships, subscriptions, digital resources, mailing lists, enquiries and related services. ForceMap software use is also governed by the applicable End User Licence Agreement.

1. About UGE

Ultimate Golf Performance Pty Ltd trading as Ultimate Golf Education provides golf education, training resources, in-person education, online courses, memberships, subscriptions and software-related services including ForceMap by Ultimate Golf Education.

2. Acceptance

By accessing the website, creating an account, enrolling, booking, purchasing, subscribing, downloading resources or using our services, you agree to these Terms and any product-specific terms displayed at the time of purchase or access.

3. Accounts and access

  • You must provide accurate information and keep account credentials secure.
  • Access is personal to the purchaser, member or authorised user unless we agree otherwise.
  • We may suspend access where there is non-payment, misuse, security risk, breach of terms or suspected unlawful activity.

4. Online learning, memberships and subscriptions

Access periods, inclusions, renewal dates, pricing, limits and cancellation steps are set out on the relevant offer, checkout, invoice or platform page. Some subscriptions renew automatically unless cancelled before renewal. It is your responsibility to manage renewal settings and payment details.

5. Workshops and in-person events

Workshop places may be limited and may require advance payment. We may change venue, schedule, presenter or format where reasonably necessary. If we cancel an event, we will provide the remedy required by law and may offer transfer, credit or refund options.

6. Refunds, cancellations and consumer rights

We handle refunds and cancellations according to the offer terms, these Terms and any rights you have under Australian Consumer Law or other mandatory laws. Nothing in these Terms excludes non-excludable consumer guarantees. Change-of-mind refunds are not guaranteed, especially after digital content has been accessed, a membership period has started, a software licence has been activated, or a workshop place has been reserved, unless required by law or agreed by us in writing.

7. Education and performance disclaimer

UGE content is educational and general in nature. It is not medical, physiotherapy, injury rehabilitation, legal, accounting or financial advice. Golf improvement, business results and performance outcomes depend on many factors and are not guaranteed.

8. ForceMap and software-specific terms

ForceMap is specialist software for golf coaching and performance workflows. It is not a medical device and does not provide clinical diagnosis or treatment advice. Use of ForceMap is subject to the applicable EULA, licence terms, hardware/software requirements and support limits.

9. User content and permissions

If you upload, send, display or discuss player, student, client, athlete, swing, video, force plate, health-related or business material, you confirm you have the permissions needed to use and share it. You retain ownership of your content but grant UGE the rights needed to provide support, education, services and account administration.

10. Intellectual property

The website, courses, workshop materials, resources, copy, graphics, videos, templates, software, product names, methods and branding are owned by UGE or its licensors. You must not copy, redistribute, resell, scrape, reverse engineer, bypass access controls or create competing materials from our content without written permission.

11. Acceptable use

  • Do not use the services unlawfully or harmfully.
  • Do not share login details, licence keys or paid resources outside your permitted access.
  • Do not interfere with our systems, forms, analytics, licences, payment systems or security controls.
  • Do not submit confidential, sensitive, offensive or third-party material unless you have permission and it is necessary for the service requested.

12. Third-party services

Our services may rely on third-party platforms for learning delivery, email, payments, analytics, calendars, hosting, forms, software licensing and support. Those providers may have their own terms and privacy practices.

13. Liability

To the maximum extent permitted by law, UGE is not liable for indirect loss, lost profits, loss of data, business interruption, loss of opportunity or reliance on educational or software outputs. Where liability cannot be excluded, it is limited to the remedies permitted by law.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, unless mandatory laws require otherwise.
